This Privacy Policy describes how The Human Sentience Company, a Delaware company doing business as The Sentience Company ("Sentience"), collects, uses, and shares information when you use our website (sentience.com), desktop and mobile applications, APIs, and related services (collectively, the "Service").
The Service exists to build a personal, user-specific digital representation for you: your Personal Sentience Model, as defined in our Terms of Service. That means the Service handles deeply personal data, and this policy explains exactly what we collect, why, and the controls you have. Terms capitalized here have the meanings given in the Terms of Service.
1. Information we collect
Information you provide
- Account information: your name, email address, and authentication details when you create an account, including information from a sign-in provider such as Google if you use one.
- Settings and instructions: preferences, instructions, memories you create or edit, and feedback you send us.
- Payment information: if you subscribe to a paid plan, our payment processor collects your payment details. We receive transaction records but do not store full card numbers.
Content from you and your connected services (User Data)
With your authorization, the Service collects the content it needs to build and operate your Personal Sentience Model. Depending on what you enable, this can include:
- messages, emails, calendar events, contacts, files, and documents from accounts you connect;
- audio recordings you capture through the Service, such as meetings and conversations, and transcripts of them;
- voice recordings you provide to create a voice representation (voice clone) of your own voice, if you enable that feature (see Section 4);
- screen captures from devices where you enable screen capture. Captures pass through a filter that runs locally on your device first, so password managers and windows you exclude are blocked before anything leaves your machine, and you can exclude applications or pause capture at any time;
- the memories, knowledge, and other representations the Service derives from the above for you.
You control which sources are connected and can disconnect a source, delete captured content, or pause capture whenever you want.
Information collected automatically
When you use the Service we collect usage and device information such as IP address, browser and operating system type, device identifiers, pages viewed, features used, timestamps, and diagnostic and crash data. On our website we use cookies and similar technologies for sign-in, preferences, security, and analytics. You can control cookies through your browser settings; some parts of the Service may not work without essential cookies.
2. How we use information
We use the information described above to:
- provide, operate, maintain, and secure the Service;
- build, update, and personalize your Personal Sentience Model, for you and only for you;
- carry out actions you request or approve, such as drafting and sending a message;
- respond to support requests and communicate with you about the Service;
- send marketing communications you can opt out of at any time;
- monitor, analyze, and improve the Service;
- detect and prevent fraud, abuse, and security incidents; and
- comply with legal obligations.
We do not sell your personal data. We do not use your User Data or Personal Sentience Model to train models shared across customers or made available to third parties unless you give separate, express, informed consent, as described in the Terms of Service.
3. AI processing
The Service uses third-party AI providers to process your content, including language-model, transcription, and voice providers. We have zero-data-retention agreements with every AI model provider we use: they may not retain, log, or train on your data, and your content is not stored on their systems beyond what is needed to return a response. Your data is used to serve you; it does not become part of a dataset that serves anyone else.
4. Voice data and biometric identifiers
If you enable voice features, we collect recordings of your voice and create a voice representation (a voice clone) from them. Depending on where you live, a voice representation may be considered a biometric identifier or biometric information under laws such as the Illinois Biometric Information Privacy Act.
- Consent first: we collect voice recordings for cloning and create a voice representation only after you expressly consent during voice-clone enrollment.
- Purpose: your voice representation is created and used only to provide voice features of the Service to you and at your direction. We do not sell, lease, trade, or otherwise profit from your biometric data, and we do not use it to identify you to anyone else.
- Retention and destruction: we retain your voice recordings and voice representation only while you keep the voice feature enabled. They are permanently destroyed when you delete your voice clone or your account, and in any event no later than three years after your last interaction with the Service.
5. Human access to your data
Your content is processed by automated systems. No one at Sentience or at our AI model providers reads your data in operating the Service. The only exception is legal compulsion: we or our providers may be required to disclose data by a valid warrant, court order, or equivalent legal process. We require valid legal process for government demands, and where the law permits, we will notify you before disclosing your data in response to one.
6. How we share information
We share personal information only in these situations:
- Service providers: companies that help us run the Service (cloud hosting, AI model providers, payment processing, analytics, error monitoring, and email delivery) under contracts that limit their use of your data to providing services to us.
- At your direction: when you approve an action that sends information to someone else, such as sending an email or sharing content, the recipient receives what you chose to send. If you enable a sharing feature, such as letting other people chat with your Sentience, the people you share with can see what you choose to make available to them, and you can change or turn that off at any time.
- Legal reasons: to comply with law or valid legal process, or to protect the rights, safety, or property of you, Sentience, or others.
- Business transfers: in a merger, acquisition, financing, or sale of assets, your information may be transferred. Any successor must honor your ownership, export, and deletion rights as described in the Terms of Service, and we will provide notice before your data becomes subject to a different privacy policy.
- With your consent: for any other purpose you agree to.
We do not share your personal data with third parties for their own marketing, and we do not share it for cross-context behavioral advertising.
7. Retention and deletion
We keep your information for as long as your account is active or as needed to provide the Service. When you delete content (a memory, a thread, a connected source) or delete your account, we remove the related data from our active systems. Residual copies may persist for a limited time in backups and security logs before they roll off, and we may retain information where the law requires it or in a form that can no longer identify you.
8. Your rights and controls
Directly in the Service, you can:
- view, edit, and delete memories and other content;
- connect and disconnect data sources;
- pause or exclude applications from screen capture;
- export your data where the Service supports it; and
- delete your account in Settings.
Depending on where you live, you may also have legal rights to access, correct, delete, or receive a copy of your personal data, and the right not to be discriminated against for exercising them. We honor these rights for all users regardless of location. To exercise a right you cannot complete in the app, email [email protected]. We will verify your request and respond within the time required by law. If we deny your request, you may appeal by replying to our response; if your appeal is denied, you may contact your state attorney general.
9. US state privacy rights
Some of what the Service collects is considered sensitive personal information under US state privacy laws, such as the contents of your messages and email, biometric data (Section 4), and health information that may appear in your content. We collect and use sensitive personal information only as reasonably necessary to provide the Service you request, and not for the additional purposes that would require a "Limit the Use of My Sensitive Personal Information" option.
We do not sell personal information and we do not share it for cross-context behavioral advertising, and we have not done either in the preceding 12 months. Because we do not sell or share personal information, an opt-out preference signal such as Global Privacy Control does not change how we treat your data, but we honor such signals where the law requires.
10. Security
Your data is encrypted in transit using TLS and at rest using AES-256. Access to production systems is tightly restricted, and screen captures are filtered on your device before upload. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but protecting this data is the core of our job, and we treat it that way.
11. International transfers
We are based in the United States and process data there. If you use the Service from elsewhere, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. We take reasonable steps to ensure your data is treated securely and in accordance with this policy wherever it is processed.
12. Children
The Service is not directed to children and requires users to be at least 18 years old (or the age of majority where they live, if higher), as described in the Terms of Service. We do not knowingly collect personal data from anyone under 13. If you believe a child has provided us personal data, contact us at [email protected] and we will delete it.
13. Links to other websites
The Service may link to websites and services we do not operate, and connected services are governed by their own privacy policies. We are not responsible for the privacy practices of third parties, and we encourage you to review their policies.
14. Changes to this policy
We may update this Privacy Policy from time to time. If a change materially affects how we handle your personal data, we will notify you by email or a prominent notice in the Service before it takes effect, and we will update the "Last updated" date above.
